The Ministry of Justice (DoJ) has filed a Complaint against Texas To block the law of two decades of the State which provides tuition fees to the State to illegal immigrants.
The complaint was filed Wednesday in the Northern Texas District against the State of Texas and several managers of Texas so that Texas complies with federal requirements.
Under federal law, higher education institutions are prohibited from providing advantages to illegal foreigners not offered to American citizens.
THE Doj complaint aims to ban the application of a Texas law forcing colleges and universities to provide school rates in the State to immigrants who maintain residence in Texas, whether in the United States legally.
According to the doj, the laws of Texas are “manifestly” in conflict with federal law, by putting them in conflict with the supremacy clause of the American Constitution.
“Under federal law, schools cannot provide advantages to illegal foreigners that they do not provide to American citizens,” said the Attorney General said Bondi said. “The Ministry of Justice will fight tirelessly to justify federal law and will ensure that American citizens are not treated as second -class citizens in the country.”
The trial was filed in response to two decrees signed by the president Donald Trump Since returning to the Oval Office in January.

The decrees have been signed to ensure that illegal immigrants cannot receive taxpayer or preferential processing services.
One of the orders, “putting an end to the subsidy of taxpayers of open borders”, ordered all agencies of “ensuring, to the maximum extent authorized by law, that no advantage financed by taxpayers goes to unqualified foreigners”.
The other order, “protection of American communities against criminal foreigners”, commands managers to “take the appropriate measures to stop the application of laws, regulations, policies and state practices to all groups of American citizens who are illegal, exercised by federal law, or otherwise inappropriate, including American laws.

Widely known as Texas Dream Act, the legislation referred to by the Trump administration was introduced in February 2001, when the federal courts have judged that the immigration status of a child should not prevent children’s access to primary and secondary schools.
But with regard to higher education, the status of federal immigration could have prevented certain children born outside the United States from obtaining college studies in a public establishment due to higher prices billed for non-residents.

When children born outside the United States obtained its secondary school diploma from Texas, these students were required by the law of the previous state to pay a higher rate in public colleges or universities in Texas, as if they came from outside the State or were international students.
The legislation, signed by Governor Rick Perry, a Republican, on June 16, 2001, abolished the status of federal immigration as a factor in determining the eligibility for the tuition fees in the public colleges and the universities of Texas for students who obtained their diploma from Texas High School and which meet the criteria of minimum, academic and registration residence.
