Lawyers for Sean “Diddy” Combs Successfully submitted a letter to support a renewed request for a trial, citing the misconduct of the prosecutor, according to the documents obtained by Fox News Digital.
In the letter, deposited on June 7 in the South District of New York, Diddy’s legal team argued that the accusation had knowingly presented false testimonies at the Court.
The jurors heard a testimony Last week, from Cassie Ventura’s friend, Bryana “Banana” Bongolan, who said that Diddy had pushed him back from a 17th floor balcony in September 2016. Parties of his testimony were questioned after Bana did not remember the details of the alleged incident, including the drugs she was at the time.

“When the introduction of a parjé testimony translates into a criminal conviction and” the accusation knew or should have known the perjury, the conviction must be canceled “if there is a reasonable probability that the false testimony could affect the judgment of the jury” “” “” Diddy’s Team wrote.
“In addition,” the use known by the prosecutor of the testimonies parjée can violate the regular procedure clause even if it only undermines the credibility of a witness. “”
Diddy’s legal team wrote that Cassie and Bana each provided “obviously false” evidence on the allegation of the balcony to the Court, then doubled, using this false testimony to obtain a decision also admitting hearing proofs on this subject, to present a false story to the jury “.

The defense lawyer then asked if Diddy was on stage in New Jersey on September 25, 2016, which she said that she did not remember. Westmoreland asked if Diddy and Cassie were in New York on September 26, 2016, which Bana said she was not aware. There was a brief sidebar.
Westmoreland again asked if she knew that Diddy and Cassie was in New York on September 26, 2016. She said no. Westmoreland asked Bana if she knew there was a signature at Macy’s. Bana said no again.
“You agree that a person cannot be in two places at the same time,” said Westmoreland. Bana replied: “In theory like Yeah … Difficult to answer this one.”

Westmoreland also asked if Bana told the government that it was on MDMA, GHB and cocaine. Bana said, “I didn’t say these words.” She said “that it was a lot of drugs” and said that she hadn’t done them that night.
“The government knew or should have known that this testimony was parjée and that Ms. Bongolan could not have been injured by Mr. Combs on a Los Angeles balcony at the start of the morning of September 26, or even the day before,” said the letter asking for an error.
“It emphasizes that the use of the parjured testimony concerning the Balcony incident is only an example of public prosecutor during this trial.”
