Will Smith is facing new legal scrutiny after a former touring musician’s explosive allegations sparked a serious court battle.
The Oscar winner was sued by Brian King Josephwho alleges sexual harassment and wrongful termination during Smith’s Based on a True Story: 2025 tour.
Although Smith has strongly denied the accusations, the lawsuit describes a series of events that Joseph says left him emotionally, professionally and physically damaged.

Will Smith has been named in a lawsuit filed by Brian King Joseph, a violinist who performed on the actor’s Based on a True Story: 2025 tour.
Joseph, who gained national recognition as a top-three finalist on “America’s Got Talent” in 2018, says his professional relationship with the 57-year-old began after he performed for the star at his home in November 2024.
According to court documents reviewed by theDaily MailJoseph was then hired to perform at Smith’s December 2024 concert in San Diego and later joined the full tour.
During this time, he also played on the “Fresh Prince of Bel Air” star’s album “Based on a True Story.”
Joseph alleges the two grew closer during their working relationship, spending what he described as “extra alone time” together.

At one point, the violinist claims Smith told him, “You and I have such a special bond that I don’t share with anyone else.” »
The lawsuit alleges that this proximity later became the basis for what Joseph describes as inappropriate behavior.

According to the lawsuit, a major turning point occurred on March 20, 2025, during the tour’s first stop in Las Vegas.
Joseph claims he returned to his hotel room around 11 p.m. and discovered that an “unknown stranger had entered the room illegally.”
Although hotel security apparently found no signs of a break-in, Joseph says the room was clearly disturbed.
Inside, he allegedly found a handwritten note saying: “Brian, I’ll be back as soon as possible.” [sic] 5:30 p.m., just us,” accompanied by a heart and signed “Stone F.”

The lawsuit further alleges that the note was left next to several personal items, including “wipes, a beer bottle, a red backpack, a bottle of HIV medication with another person’s name on it, an earring, and hospital discharge paperwork belonging to an individual without the plaintiff’s knowledge.” »
Joseph says this discovery terrified him. According to court filings, he feared someone would “return to his room to engage in sexual acts” with him.

Following the incident, Joseph said he immediately contacted hotel security, a non-emergency police line and Smith’s management team.
He also took photos of the items left in the room and requested a room change. Joseph maintains his concerns were solely about safety.
In the lawsuit, he says he “made it clear that his only concern was safety and that he did not wish to receive any special treatment or compensation.”
According to him, he did not at any time seek any financial advantage or special favors following the reporting of the incident.
The suit also points out that hotel room access details were shared via a spreadsheet given to the band and crew, arguing that only “the crew and hotel staff would have had access to the plaintiff’s hotel room.”
This detail is used to support Joseph’s claim that the entry was not random or accidental.

Days after reporting the alleged incident, Joseph claims he was confronted by a member of tour management.
According to his court documents, this individual would have “shamed” him and would have directly blamed him for what had happened.
The 32-year-old claims the manager told him: “Everyone tells me what happened to you was a lie, that nothing happened and you made it all up. So tell me, why did you lie and make it up?”
Shortly after, Joseph said he was fired from the tour and replaced.
Joseph alleges that the situation supports the assertion that Smith was “deliberately grooming and grooming Mr. Joseph for further sexual exploitation.”

Smith has denied all allegations through his attorney, Allen B. Grodsky.
In a statement to Daily MailGrodsky said: “Mr. Joseph’s allegations regarding my client are false, baseless and reckless. »
He added: “They are categorically denied, and we will use all available legal means to respond to these allegations and ensure the truth is revealed. »
Meanwhile, Joseph claims the consequences of his dismissal led to a serious deterioration in his health.
Court documents say the stress led to “major physiological damage” and that he “suffered PTSD and other mental illnesses as a result of the termination.”
Joseph formally filed suit this week in California Superior Court, Los Angeles County, and is demanding a jury trial.
