On Monday, January 5, 21 additional class action lawsuits were filed against several casino operators in Alabama, joining a number of filings in 2025 to bring the total number of civil actions filed against these platforms to more than 40 since the start of 2025. This makes Alabama the state with the highest number of such legal disputes.
In court documents shared by gaming attorney David Wallach, one of the 21 lawsuits filed is against Heuston Gaming and is defined as “a private attorney general action” because it is only brought by one person. He seeks to recover money lost in games of chance to make it available to members of the player’s family.

“The Legislature chose to allow any person to file a complaint and to allow benefits to accrue to the family of losing players, whether or not that person is an appropriate class representative under the law. Rule 23“, we read in the file.
In Alabama, Rule 23 outlines the requirements for certifying a lawsuit as a class action.
Alabama Lawsuits Put Sweepstakes Operators Under Microscope
The 2025 lawsuits were similar in nature, with players seeking to recoup their losses from operators. As Alabama is one of the US states that has almost completely banned gambling, lottery operators have so far skirted legal limits by relying on virtual currencies. The operators claim that their services and games are not gambling because they operate on a “Prize-Chance-Consideration” method, rather than real money.
The law prohibits gaming machines in Alabama, preventing casinos from truly gaining a foothold. It may not last much longer, as the Poarch Band of Creek Indians begins pushing for sports betting and table games to come to the state.
Lawsuits like those mentioned above, as well as previous lawsuits against High 5 Entertainment And Stake.us highlight the reluctance towards this way of operating. The plaintiffs argue that unlicensed and illegal games were offered, negating the money lost along the way.
