Male film sues Mia Gothic for allegedly intentionally kicking her in the face, asked a judge to help get the actress to show up for a deposition, Us every week can exclusively report.
Tuesday January 6 James Hunter filed court documents demanding that Goth, 32, provide available dates for his dismissal as part of his trial.
Hunter, who claimed Goth committed battery on the set of the 2024 horror film MaXXXinesaid he was deposed on September 19, 2024. He said it was “contentious” and after several hours of questioning, the defendant’s lawyer “abruptly announced a suspension of the deposition and left without [Hunter’s] consent or court order.
In his filing, Hunter said the defendants, who also include the film’s director, You westand the A24 studio, have not planned a follow-up to his deposition for months. He said he should not be forced to sit for a second deposition until Goth appears for his deposition.
Hunter’s filing argued that “Ms. Goth’s testimony should be highly relevant, and delay her deposition while refocusing on [Hunter] could cause harm [Hunter’s] ability to fully develop one’s claims and defenses.
He continued: “Defendants’ inaction and Ms. Goth’s continued unavailability for deposition create an uneven playing field that the Court can correct by ordering that her deposition take place first. »
Hunter also requested that when he sits for a second deposition, it be done remotely. He claimed the first session took a toll on him and caused him to experience “significant health problems triggered by stress: including migraines, panic attacks and episodes of severe anxiety.”

In the lawsuit, he explained that he worked as an extra as a “dead parishioner” in MaXXXine. Hunter, whose body was covered in fake blood, was asked to lie down on the ground while Goth ran in front of him. He said he had to deal with ants and mosquitoes while filming.
Hunter alleged that after a few takes, he said he informed the assistant director that Goth was about to step on his head. He claimed Goth had been informed of the problem.
The suit alleged: “Despite the warning and in the following take, Goth intentionally and willfully assaulted [Hunter] kicking [Hunter] on the side of his head with his boot. Hunter’s lawyer said Goth did it “to punish [Hunter] and to retaliate against [Hunter] For [Hunter] reporting to the 2nd assistant director… that Goth had gotten dangerously close to [Hunter] in a previous take.
Hunter claimed Goth invaded his privacy in a bathroom and “mocked, taunted, mocked, and belittled him” and “challenged” him to “do anything about it.”
“Goth’s conduct was scandalous and calculated to cause, and did cause, [Hunter] injury and serious emotional distress,” the suit alleges. “Goth caused harmful, offensive and violent physical contact with [Hunter].”
Hunter sought damages of more than $500,000 for alleged battery and wrongful termination. Goth and the other defendants have denied all allegations of wrongdoing.
The actress argued that Hunter consented to and approved all of the acts he now complains about in his lawsuit.
Goth also argued that if Hunter had indeed suffered injuries, which she denies, those injuries would have been caused, in whole or in part, by Hunter’s own actions or those of third parties. Goth demanded that all claims be dismissed and that the extra be made to pay her legal fees related to the case.
MaXXXinewhich is part of West’s horror trilogy, alongside the 2022 films X And Pearlmade over $22 million on a budget of less than $10 million. Goth followed MaXXXine with 2025 Frankensteinfor which she received rave reviews.
