The Dutch gaming authority, known as Kansspelautoriteit (KSA), has issued a notice to TOTO Online for “violation of the Prevention of Money Laundering and Terrorism Financing Act.”
The regulator claims that the company failed to continuously monitor business relationships and their transactions, which are supposed to take place after the customer’s first investigation.
“The statement states, among other things, that TOTO Online, in some cases, does not indicate clearly enough why new facts or events do not lead to an adjustment of customers’ risk classifications and why it takes certain management measures. In addition, the investigation into the origin of players’ money is not sufficient,” the KSA says in a statement. translated press release.
According to the gaming authoritygaming providers are required to monitor gaming behavior and investigate if necessary, for example in the event of sudden deposits of large sums. The regulator has published a Wwft guideline on the website, which highlights risks such as high deposits, even when they come from the player’s bank account.
TOTO Online is described as cooperating during the investigation, and some of the violations initially found ended before the direction was given. They must now end the violations within six months and, once that time has passed, the KSA will conduct a new audit.
The press release was issued on December 24, with the regulator also sharing details of a separate incident a few days prior (December 22) involving LeoVegas. It was then that the gaming authority announced that it had fined LeoVegas for failing to sufficiently comply with its duty of care between October 2023 and May 2024.
As a result, a fine of €500,000 was imposed after the KSA requested several player files from the company and found that they showed a failure to comply with duty of care.
